Terms of Service

These terms govern your use of Azonyx. They are written to be read rather than skimmed past, because the parts that matter — what happens to your phone number, what the AI can and cannot be trusted with, and whose job consent is — are ones you will want to have known in advance.

1. What Azonyx does

Azonyx provides software that answers calls and messages for your business. Depending on the plan you choose, that includes texting back missed calls, replying to texts and direct messages, answering the phone with a voice assistant, booking appointments and sending reminders, and asking customers for reviews after a job.

Azonyx is a tool you operate, not a person you employ. It acts on the information you give it and the settings you choose.

Monthly fees are billed in advance and cover normal use, including the calls and messages the service sends on your behalf and the phone number it uses. There is no setup fee.

Each plan includes a generous allowance of calls and messages. If your usage is consistently far beyond what the plan assumes, we will talk to you about moving plan before we charge you anything extra. We will not add a surprise charge to an invoice.

Fees may change with 30 days' written notice. If a price rise does not suit you, cancel before it takes effect and you will not pay it.

3. The revenue share on Full

On the Full plan, Azonyx manages advertising for your business, and we charge 10% of the revenue that advertising generates, in addition to the monthly fee.

Revenue is counted per invoice, and only where a booked and completed job can be traced back to an advertisement we ran, within the attribution window set on your account. The fee is calculated on the invoiced amount for those jobs.

4. Cancelling, and your phone number

Azonyx is month to month. There is no minimum term and no cancellation fee. Cancel with 30 days' notice and the service runs to the end of that period.

If Azonyx provided your phone number, that number is released when you cancel and you will lose it. If you want to keep it, tell us before you cancel and we will help you port it to your own carrier. Porting takes time, so start it early rather than on your last day.

If you brought your own number, it stays yours throughout and nothing happens to it when you leave.

On cancellation the agents stop and your records are retained rather than deleted, so that consent and opt-out history remains provable and so your account can be restored if you come back. You may ask us to delete your data; see section 8.

5. Your responsibilities

Azonyx sends text messages on behalf of the businesses that use it. Messages go only to people who contacted the business first — they called it, texted it, or booked an appointment with it. There is no subscriber list, no purchased or rented data, and no bulk sending.

What recipients receive

A reply to a missed call, an answer to a text or message, a booking confirmation, an appointment reminder, and — after a completed job — one request for feedback. Every message relates to that person’s own call, appointment or job.

Opting out, and getting help

The first message in every conversation identifies the business by name and includes “Reply STOP to opt out”. Replying STOP ends messages immediately and permanently, and that number is not messaged again. Replying HELP returns contact information.

Frequency and cost

Message and data rates may apply. Message frequency varies, because messages are a response to the recipient’s own activity rather than a schedule — someone who calls once and books once receives a handful; someone who never contacts the business receives none.

Carriers are not liable for delayed or undelivered messages. How personal information and messaging consent data are handled is set out in the Azonyx Privacy Policy.

If you are the business using Azonyx

Every conversation opens by naming your business and telling the recipient they can reply STOP, and a STOP is honoured immediately and permanently.

That design does a great deal of the work, but the messages are sent in your business's name, so compliance with the Telephone Consumer Protection Act and the carriers' own rules remains your responsibility as the sender. In practice that means: do not load contacts into the system who have not contacted you, do not use the service to send marketing or promotional messages, and do not ask us to override an opt-out. We will refuse.

If you ask us to do something that would breach those rules, we will decline and explain why. If you do it anyway through your own use of the system, that is on you, and section 10 applies.

7. What the AI is and is not

Parts of Azonyx are powered by artificial intelligence. It is good, and it is not perfect. It will occasionally misunderstand a question, or answer something it should have passed to you.

We build against that: the assistant answers only from information you have given it, it hands off to a person when it is unsure rather than inventing an answer, and everything it sends is visible to you.

You should still supervise it, especially early on and especially on anything involving a price or a commitment. We do not guarantee that every AI-generated message is accurate, and you remain responsible for what your business says to its customers. If the assistant gets something wrong, tell us — that is how it gets corrected.

8. Your data

Your customer records are yours. We process them to run the service for you and for nothing else. We do not sell them, we do not use them to benefit another business, and we do not use them for advertising.

You can export your data at any time, and ask us to delete it when you leave. We will, except for the record of who has opted out of messages — that one we keep, because it exists to protect the people who asked not to be contacted, and deleting it would put them at risk of being messaged again.

9. Availability

We aim to keep Azonyx running at all times and we monitor it continuously. We do not offer a formal uptime guarantee, and parts of the service depend on providers we do not control — the phone network, the messaging carriers, the AI providers. If an outage is our fault and it meaningfully affects you, tell us and we will credit your account fairly.

10. Liability

Azonyx is provided as it is. We do not warrant that it will never miss a call, never misread a message, or never be unavailable.

To the extent the law allows, our total liability to you for any claim is limited to the fees you paid us in the three months before the claim arose. We are not liable for lost profits, lost business, or indirect losses.

None of this limits liability for our own fraud, or for anything that cannot lawfully be limited.

You are responsible for claims arising from your own use of the service in breach of section 6 — messaging people who did not consent, or sending marketing through a system that is not for it.

11. Suspension

We may suspend an account that is being used unlawfully, that is putting our carrier relationships at risk, or whose fees are more than 30 days overdue. Except where the law or a carrier requires immediate action, we will contact you first and give you a chance to put it right.

12. Changes to these terms

If we change these terms materially, we will give you 30 days' notice by email. Continuing to use Azonyx after that means you accept the change. If you do not, cancel within the notice period.

13. Governing law

These terms are governed by the laws of the State of Arizona, United States, and any dispute will be handled in the courts of that state.
